Terms and Conditions for Dare Teams

  1. The closing date for applications, including teams from China as India are set out on this website are final. Entries received after this date will not be considered.
  2. Dare to be Digital is open to undergraduate or postgraduate students studying at Universities or Art Colleges. 
  3. Entry for teams must be 5 members.
    Entry for Chinese and Indian teams must be 4 members.
  4. Teams whose students are all graduating in 2010 are eligible to apply.
  5. A maximum of 2 members in a team of 5 from UK/Ireland, similarly a maximum of 1 member in a team of 4 from China/India, can be graduates of up to 2 years as long as they are not currently employed in the games / interactive entertainment industries. The rest of the team must fit the normal entry criteria as set out in (2) above.
  6. A maximum of 2 members in a team of 5 from UK/Ireland, similarly a maximum of 1 member in a team of 4 from China/India, can be studying at an FE college as long as the remaining 3 team members fit the normal criteria as set out in (2) and (5) above.
  7. Applications from individuals are not permitted.
  8. No applicant should have had any extensive (more than 6 months full time) work experience in the games industry as a graduate or study break. Part time relevant work and internships undertaken during consecutive years of study are permitted.  Please refer to the Dare team if you are unsure. 
  9. Applicants who have previously taken part in the Competition are not permitted to apply. This includes applicants who were successful in securing a place in the Competition but who later withdrew from the Competition either prior to its commencement or after the Competition had started.
  10. Applicants who have previously applied to the Competition can re-apply. This includes applicants who were successful in getting to the interview stage but who were then not selected to take part in the Competition.
  11. The dates (as set out on the website) for the selection days will be the sole dates for selection. No other date will be set with any team.
  12. The Competition will be hosted at Abertay University, Dundee, Scotland from Monday 7th June until Sunday 15th August 2010. Each Team Member is required to work on the Team Project at the host centre for a minimum of 35 hours per week during Normal Working Hours.
  13. Each Team Member is entitled to a maximum of 1 week’s unpaid leave from the Competition, to the prior consent of the Competition Organiser (University of Abertay Dundee) and which does not impinge on the Team Project and has the approval of all fellow Team Members. No other leave from the Competition is permitted except with the consent of the Competition Organiser and will only be granted in the event of exceptional circumstances, of which the Competition Organiser will be the sole judge.
  14. All Team Members will be present during Normal Working Hours on Compulsory Attendance Days (comprising the first and last two weeks of the Competition).
  15. No Team Members are allowed to engage in any form of paid employment during the course of the Competition other than work out with Normal Working Hours which has the prior consent of the Competition Organiser, and which does not impinge on the Team Project and has the approval of all fellow Team Members.
  16. A judging panel involving industry and funding representatives will determine which teams will be selected to take part in the Competition. The judges’ decision is final and not open to negotiation. No correspondence will be entered into.
  17. All works and ideas submitted must be original and not infringe any copyright.
  18. All Dare participating teams will start developing their game when the competition starts. No pre-developed game is allowed to enter the competition. The concept art or other materials produced for application purposes will need to be declared after the team have successfully entered the competition.
  19. Successful applicants will have to abide by the IPR conditions set for the Competition as follows:

    1. Each Team agrees that they will assign any Intellectual Property Rights generated in pursuance of the Team Project to the Competition IPR Holder. If the majority (3) of the Team form a legally constituted Partnership or Limited Company with partner/shareholder agreements in place to exploit the Intellectual Property Rights, or has an agreement from the majority (3) of the Team members to exploit the IPR generated in the Competition, these agreements being acceptable to the Competition Organiser, the Competition Organiser will negotiate an Assignation of IPR to the Partnership or Limited Company to allow exploitation of the Intellectual Property Rights. Any agreements entered into will require a royalty payment to be granted to the Competition Organiser. Royalty payments will be subject to revenue thresholds agreed at the time of assignation being exceeded.
    2. Each Team Member is required to vest any personal Intellectual Property Rights including any background Intellectual Property Rights required in relation to the Team Project in the Competition IPR Holder and can only exploit such personal Intellectual Property Rights as part of the Team Project IPR (which for the avoidance of doubt will also require to be assigned to the Competition IPR Holder unless otherwise agreed by the Competition Organiser. Should any Team Member decide to leave the Competition at any point for any reason whatsoever, the Team Member will be required to leave any work undertaken in pursuance of the Team Project with the Team, including any Intellectual Property Rights generated by the Team Member. For the avoidance of doubt, remaining Team Members can continue with the Team Project.
    3. Each Team Member warrants to the Competition Organiser that any background or other Intellectual Property Rights used or generated in the Team Project shall not infringe the Intellectual Property Rights of any third party. Team members warrant that their Team Project will not include defamatory or pornographic content.
  20. On completion of the Competition each Team/Team Member shall consent to taking part in filming of a documentary film of the Competition for the Competition period. The Competition Organiser shall be entitled to use any such film for any purpose at its sole discretion. This will be used in the promotion of the Competition.
  21. In addition, as which will be detailed at the Induction Day before the start of the Competition, the Team shall provide the Competition Organiser with a full working copy of the game, together with screen images and artwork in adequate time for inclusion in the final showcase event Dare ProtoPlay.
  22. The Competition Organiser's decision is final and binding in all matters relating to the Competition and the application of these terms and conditions. No correspondence will be entered into. No appeals or protests of any sort will be permitted.
